Facing impeachment after declining to resign following the recommendation of the just-retired CJI Sanjeev Khanna, the Delhi High Court judge Justice Yashwant Varma is understood to be preparing could challenge the report of the Supreme Court committee that has indicted him. Family sources close to Justice Varma have indicated to The Squirrels that a defence is being prepared and that they believe he has been ‘framed and deeply wronged’.

Justice Varma is at the centre of a controversy involving a fire in the outhouse of his official residence, which led to the discovery of allegedly large sacks of cash. He denied any knowledge of the cash. The judge was transferred to the Allahabad High Court without judicial duties, after a three-member SC committee in an in-house probe. 

100-page rebuttal ignored

Sources close to the Varma family have said that the defence will contest the committee’s findings and will fight to ‘clear the family and judge’s name and honour’. The sources said that a rebuttal of all charges that ran over 100 pages was ‘glossed over’ and all the questions raised in it ignored by the SC’s probe committee. 

The rebuttal reportedly also includes details about an alleged explosion that was heard before the fire broke out. The sources say that this was never probed deeper and could point to an arson angle. 

The sources also said that the family was ‘lynched in the media’ but the videos available in the public domain show no evidence of any sacks full of money. 

It is important to note here that a previous judgment prevents in-house judicial probes from being made public. 

Cash discovery row: Justice Yashwant Varma indicted; could face impeachment

Meanwhile, a three-member judicial committee indicted Justice Yashwant Varma last week. He was serving as a judge at the Delhi High Court. This followed the alleged discovery of cash at his residence during a fire incident on March 15–16, according to sources on Wednesday.

Chief Justice of India (CJI) Sanjiv Khanna has sought a response from Justice Varma, who is now a judge at the Allahabad High Court, after receiving the committee's report on May 4.

Sources indicated that further action against Justice Varma could depend on his response. He may be asked to resign or potentially face an impeachment recommendation. Justice Varma has consistently denied the allegations, calling the entire incident a conspiracy. "I unequivocally state that no cash was ever placed in that storeroom either by me or any of my family members and strongly denounce the suggestion that the alleged cash belonged to us," he stated.

The CJI formed the investigative committee on March 22, just days after the incident came to light. The committee comprised Justice Sheel Nagu, Chief Justice of the Punjab and Haryana High Court, Justice G S Sandhawalia, Chief Justice of the Himachal Pradesh High Court, and Justice Anu Sivaraman of the Karnataka High Court.

The panel concluded its investigation and submitted its report to the CJI on May 4.

According to the Supreme Court's ruling in K Veeraswami vs Union of India (1991), a criminal case cannot be registered against a judge of the High Court or the Supreme Court without the prior consent of the Chief Justice of India.

Following the incident, Justice Varma was transferred to the Allahabad High Court, his parent High Court, and has been stripped of any judicial responsibilities since then.
